Can ICE arrest and detain US citizens, like they are doing? NO!!!!!!!
No, ICE (Immigration and Customs Enforcement) cannot legally detain U.S. citizens.
Union Leader David Huerta was injured and arrested by ICE anyway. Hopefully he is suing.
However, they can detain individuals if there is reasonable suspicion they are not a U.S. citizen and are subject to immigration enforcement. If detained, citizens should immediately state their citizenship and request to speak with an attorney.
WHY ARE ICE ABLE TO DETAIN, ARREST, and assault US CITIZENS?
Brad Lander is another prominent example of a citizen being assaulted
and arrested by ICE
-he is the second in command of New York City
Pregnant women has delivered stillborn babies in the brutal custody of ICE.
I guess being pro-life does not apply to actual life or actual human beings.
LET'S FIND OUT about the authority of ICE
Elaboration:
- ICE's primary role is to enforce immigration laws and remove individuals who are not legally authorized to be in the United States.
- ICE does not have the authority to detain U.S. citizens.
- While ICE cannot detain citizens, they can detain individuals they reasonably suspect of being deportable aliens. This suspicion can arise from various factors, including information in databases, statements made by the individual, or observations made by ICE agents.
- If detained, it is crucial to immediately inform ICE that you are a U.S. citizen and request to speak with an attorney.
- Individuals have the right to remain silent during an ICE encounter and should exercise this right if they are unsure of their rights or the situation.
- Individuals have the right to legal representation and should request to speak with an attorney as soon as possible if detained.
- If you are detained and believe you are a U.S. citizen, it is highly recommended to seek legal assistance from an experienced immigration attorney to help navigate the situation.
- While ICE cannot detain citizens, proving citizenship can sometimes be challenging, especially if the individual is unable to immediately produce documentation like a passport or birth certificate.
- ICE often uses administrative warrants, which are ICE forms signed by ICE officers, not judges, to enter a home or detain individuals. A judicial warrant, signed by a judge, is required for law enforcement to enter a home without consent.
